How Let's Soirée protects creative work and handles infringement notices.
Overview
Let's Soirée respects the intellectual-property rights of creators, designers, artists, businesses, and other rights holders. This Copyright & Intellectual Property Policy explains the intellectual-property requirements that apply to sellers and the process for reporting alleged copyright infringement.
1. Seller Intellectual-Property Responsibilities
Sellers are responsible for ensuring that they have the necessary rights, licenses, permissions, or authorizations to use all content included in their listings. This includes: • Photographs; • Graphics; • Illustrations; • Designs; • Fonts; • Logos; • Text; • Templates; • Digital files; • Product artwork; and • Other intellectual property. Sellers may not upload, sell, distribute, or reproduce content they do not have the right to use. Examples of prohibited conduct include: • Selling pirated graphics; • Selling unauthorized digital templates; • Copying another creator's designs; • Using copyrighted artwork without permission; • Using trademarked characters without authorization; • Selling unauthorized branded merchandise; and • Representing another person's work as the seller's own.
2. Copyright Complaints
If you believe that content available through Let's Soirée infringes your copyright, you may submit a copyright complaint to: copyright@letssoiree.shop You may also use the copyright-reporting form provided through the Let's Soirée Help Center once that feature is available. Let's Soirée may remove or disable access to content that is reported as allegedly infringing while the matter is reviewed. Let's Soirée may notify the affected seller and provide the seller with an opportunity to respond where appropriate.
3. DMCA Notice Requirements
A copyright complaint intended to serve as a DMCA notice should include the information required by applicable law. Generally, a notice should include: • Identification of the copyrighted work claimed to have been infringed, or a representative list of works if multiple works are covered by the notice; • Identification of the material on Let's Soirée that is allegedly infringing, including the listing URL or other information sufficient for Let's Soirée to locate the material; • Information reasonably sufficient to contact the copyright owner or authorized representative, including name, mailing address, telephone number, and email address; • A statement that the complaining party has a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; • A statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner; and A physical or electronic signature of the copyright owner or authorized representative. Incomplete reports may not be sufficient to begin the formal DMCA process.
4. Review & Removal
After receiving a sufficiently detailed copyright complaint, Let's Soirée may: • Review the complaint; • Contact the seller; • Remove or disable access to the reported content; • Restrict the listing; • Suspend related selling activity; • Request additional information; or • Take other action permitted by law and Platform policy. Let's Soirée does not make a legal determination that a reported use is infringing merely because a complaint has been submitted.
5. Counter-Notification
If a seller believes content was removed or disabled because of a mistake or misidentification, the seller may submit a counter-notification where permitted by applicable law. A valid counter-notification generally must include: • Identification of the material that was removed or disabled and the location where it appeared before removal; • A statement under penalty of perjury that the seller has a good-faith belief that the material was removed or disabled as a result of mistake or misidentification; • The seller's name, address, telephone number, and email address; • A statement that the seller consents to the jurisdiction of the appropriate federal district court and agrees to accept service of process from the person who submitted the original notification or that person's agent; and • The seller's physical or electronic signature. Where applicable, Let's Soirée may follow the statutory process for restoring content after a valid counter-notification.
6. Repeat Infringer Policy
Let's Soirée may restrict, suspend, or permanently terminate accounts or shops that repeatedly engage in confirmed copyright or other intellectual-property infringement. Let's Soirée may consider: • The number of confirmed violations; • The seriousness of the violations; • Whether the seller responded to prior notices; • Whether the seller removed or corrected infringing content; • Whether additional violations occurred; and • Other relevant circumstances. Serious or deliberate infringement may result in immediate suspension or termination without waiting for multiple violations.
7. Trademark & Other Intellectual Property
Copyright is not the only form of intellectual property protected by Let's Soirée's policies. Sellers may not use another person's or company's: • Trademark; • Trade name; • Logo; • Trade dress; • Patent; • Design rights; or Other protected intellectual property without appropriate authorization. Reports involving intellectual-property rights other than copyright may also be submitted to: copyright@letssoiree.shop Let's Soirée may route such reports to the appropriate internal process.
8. DMCA Designated Agent
Let's Soirée intends to maintain a designated agent for receiving notifications of claimed copyright infringement in accordance with applicable law. The designated-agent information will be made publicly available once the applicable registration and publication requirements have been completed. 9. False Copyright Claims
Submitting knowingly false or materially misleading copyright complaints may have legal consequences. Individuals submitting copyright complaints should ensure that their claims are made in good faith and that they are authorized to act for the copyright owner where applicable.
10. Platform Enforcement
Copyright or intellectual-property violations may result in: • Listing removal; • Content restriction; • Seller warnings; • Shop restrictions; • Suspension; • Permanent removal; • Loss of selling privileges; or • Other appropriate action. Let's Soirée may also cooperate with lawful requests from rights holders, courts, law-enforcement agencies, or other authorized authorities.
